1. Acceptance of Terms

By accessing or using ddriftt, you acknowledge that you have read, understood, and agree to these Terms as well as our Privacy Policy. These Terms apply to all users of the platform.

2. Description of Service

ddriftt is a curated online travel platform that connects travelers with hotels through curated staylists created by curators. The platform allows users to discover, save, and book curated stays while curators can earn commissions on successful bookings.

3. User Accounts

Account Creation: To access some features of the platform, you must create an account. You agree to provide accurate and current information during registration and maintain your account securely.

Eligibility: You must be at least 18 years old to create an account.

Account Responsibility: You are responsible for all activities that occur under your account. You must notify us immediately if there is any unauthorized use of your account.

4. Platform Usage

By using ddriftt, you agree to:

Use the platform in compliance with applicable EU laws, Estonian laws, and international regulations.

Not engage in any activities that would harm the platform or violate these Terms.

Not use any automated systems or bots to interact with the platform.

5. Curator Responsibilities

Curators who create staylists on ddriftt agree to:

Ensure all content provided is accurate, up-to-date, and in compliance with local laws and regulations.

Promote hotels ethically and transparently, without using misleading or deceptive tactics.

Adhere to all applicable local, EU, and international marketing laws, including those governing affiliate marketing.

6. Commissions and Payments

Commission Structure: Curators earn 70% of the commission negotiated with hotels, while ddriftt retains 30% of the commission for platform maintenance and improvements.

Example: If a hotel offers a 15% commission, the curator earns 10.5% of the booking amount, and 4.5% goes to ddriftt.

Payouts:

Payment Timing: Payouts to curators and hotels will be made on the day of check-in, not at the time of booking. This ensures that the stay is confirmed before any funds are released.

Payment Method: All payouts will be processed through Stripe Connect or other secure international payment gateways.

Escrow Period: Funds for a booking will be held in escrow from the moment the guest makes the booking until the day of check-in. This protects both the guest and the curator from cancellations.

Payout Currency: ddriftt currently only supports payouts in USD, CAD, and EUR. Curators and hotels will need to provide bank accounts that can receive funds in one of these currencies.

Payout Frequency: Payouts will be transferred to the curator’s and hotel’s designated bank accounts within 48 hours after check-in has been confirmed.

7. Booking and Cancellation Process

Booking Terms: When a traveler makes a booking through ddriftt, they agree to the terms and conditions set forth by the specific hotel. ddriftt is not liable for disputes regarding the booking once the traveler has checked in.

Cancellation Policies: Cancellations are governed by each hotel’s policies. ddriftt will assist in facilitating cancellations, but the terms are subject to the hotel’s discretion.

8. Integration with Property Management Systems (PMS)

ddriftt ensures seamless API connections with the hotel’s PMS. This means:

Real-Time Availability and Rates: Hotels’ rates and availability will be synced with ddriftt to prevent double bookings.

Custom Integrations: If a hotel’s PMS is not supported, ddriftt will consider building a custom integration. Hotels can request custom API integrations based on business needs.

9. Intellectual Property

Platform Ownership: All content on ddriftt, including logos, text, and images, is owned by ddriftt and protected by Estonian and international intellectual property laws.

User-Generated Content: By submitting content to ddriftt, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the content on the platform.

10. Data Privacy and Security

We are committed to protecting your data. Please refer to our Privacy Policy for details on how your personal information is collected, stored, and used in compliance with GDPR and Estonian data protection laws.

11. Termination of Account

ddriftt reserves the right to suspend or terminate accounts if users violate these Terms, engage in fraudulent activities, or harm the platform’s integrity.

12. Limitation of Liability

ddriftt is provided “as is” and “as available,” without warranties of any kind. To the maximum extent permitted by law, ddriftt is not responsible for any indirect, incidental, or consequential damages, including loss of revenue or data.

13. Governing Law

These Terms shall be governed by the laws of Estonia and any disputes arising from these Terms will be subject to the jurisdiction of the courts in Estonia. International users must comply with applicable local and international laws when using the platform.

14. Changes to Terms

ddriftt reserves the right to modify these Terms at any time. Changes will be posted on the platform, and continued use of the platform signifies acceptance of the revised Terms.
